Membership Agreement

1. Member Benefits

As of part of membership with Private Green, the Member will receive the following benefits:

• 24/7 Access to Private Green Facility only after booking time
• Booking Website for Access to Facility
• High End Technology for improving Golf Practices and understanding golf club and ball data.
• Swing Analysis
• Indoor Golf Studio Access
• Data from Golf Swings
• Private Use of Facility
• Members will not be able to use the facility until they have booked an initial orientation of the facility with the owner

2. Membership Dues

There are 5 options for memberships:

• month-to-month ($150) – $200 Effective August 1, 2024
• Semi Annually 6-month term ($800) – $1150 Effective August 1, 2024
• Annually ($1500) – $2100 Effective August 1, 2024
• Prime Winter Membership ($1300 One Time)
• Unlimited Summer Membership ($100 3 Payments) – $150 Effective Summer 2025

Payments will be made upfront for both Semi Annually and Annual membership options and then the month-to-month option will require monthly payments at the beginning of each month.

Payment Methods: All payments must be made on the website through our membership portal using Stripe transactions.

Any member that has a failed payment will be charged a late fee of 15% of their membership price point. If a member does not pay within 7 days of the due date via automated payments their membership will be cancelled, and their access revoked.

 During your orientation you will be required to pay $5 for your keyfob. 

3. Restrictions

The Member agrees that they will not:

• Share their login or door access code with non-members
• Reproduce any of the information received as part of their membership and share it with non-members
• Post inappropriate, inaccurate, or offensive content to membership forums and discussions including but not limited to Google, Facebook, Reddit etc.
• Allow non-members to use the facility without the member.
• All non-members accompanying the member must sign the guest member agreement book upon arrival – failure to do so could lead to membership cancellation.
• Members will not host more than 3 non-members at the facility at any time. If more than 4 people including the member are using the facility at any time the member could lose their membership.
• Members will not take any equipment from the space – the member will be charged if any equipment is taken during their booking time. Members will be charged the cost of the equipment as it if was brand new. This includes if a member fails to shut the Private Green main entrance and something gets stolen the member will be responsible.

If any of these restrictions are broken the member could have their membership terminated or they could potentially be charged an additional member fee for allowing a non-member to use the facility without the member. The member will be charged for the monthly service of $150 for every infraction of the restrictions mentioned in this agreement.

4. Liability

The Member and Member Guests will not hold the Organization liable for any tangible or intangible damage (including personal equipment) that might happen to them while participating in the membership/facility. Any guests accompanying the member must sign the guest member agreement. Any failure to do so could cause a loss of membership.

The Member is responsible for their actions and the organization is not liable for any injuries that might occur from misuse of the space. All Members and Member Guests assume that there is risks involved in using the facility and the organization is not liable for any injuries that occur while the Member or their Guests are in the facility.

All guests of members will not hold the Organization liable for any tangible or intangible damage that might happen to them while participating at our facility.

The Member agrees that the Organization cannot guarantee any results from their membership. Any negative or positive results that might occur during the membership are the result of the Member’s own personal choices.

5. Privacy

The Organization will not share any contact or personal information about the Member with other members, non-members or any third parties.

6. Membership Termination

The Organization has a right to terminate the Member’s membership at any time for any reason including if any of the terms and/or the conditions of this Agreement are violated. The Member can terminate their membership at any point and for any reason and will not be charged for their
next billing cycle.

By becoming a member and clicking the checkbox that you agree to the terms of service and membership agreement, the Member confirms that they have read, understood and agree to the terms and conditions outlined in this Agreement.

The organization reserves the right to update and change this agreement as necessary.

 7. Arbitration

All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Wyoming or another location mutually agreeable to the parties. The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys’ fees. Any such arbitration shall be conducted by an arbitrator experienced in contracts and shall include a written record of the arbitration hearing. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in a court of competent jurisdiction.
